These Terms of Service ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and Fontavis Finance, LLC, together with its subsidiaries and affiliates ("Fontavis," "we," "us," or "our"), governing your access to and use of the Fontavis website located at https://fontavisfinance.com, and any related mobile applications, tools, and services (collectively, the "Platform").

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Platform for your personal, non-commercial use. This license does not include the right to:

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FONTAVIS AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AND LICENSORS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING FROM YOUR ACCESS TO OR USE OF THE PLATFORM.
In no event shall our total liability to you for all claims arising from or related to the Platform exceed the greater of (a) the amount you have paid us in the twelve (12) months preceding the claim, or (b) one hundred dollars ($100).
These limitations apply regardless of the legal theory on which the claim is based, including negligence, breach of contract, or any other theory, and even if we have been advised of the possibility of such damages.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or damages, so some of the above limitations may not apply to you.

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law principles.
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Platform shall be resolved by binding arbitration administered by the American Arbitration Association in accordance with its Commercial Arbitration Rules. The arbitration shall take place in Washington, D.C., and the arbitrator's decision shall be final and binding.
YOU AGREE THAT ANY DISPUTE RESOLUTION PROCEEDINGS WILL BE CONDUCTED ONLY ON AN INDIVIDUAL BASIS AND NOT IN A CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. You waive your right to participate in a class action lawsuit or class-wide arbitration.
Notwithstanding the above, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to protect its intellectual property rights or to prevent irreparable harm.
You may terminate your account at any time by contacting us at support@fontavisfinance.com. Termination of your account does not affect any existing investments, which will continue to be governed by their respective offering documents.
We may suspend or terminate your account and access to the Platform at any time, with or without cause, with or without notice. Reasons for termination may include:
Upon termination, your right to access and use the Platform will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property rights, disclaimers, limitations of liability, indemnification, and dispute resolution.
We reserve the right to modify these Terms at any time. If we make material changes, we will notify you by email or by posting a notice on the Platform prior to the changes becoming effective. Your continued use of the Platform after the effective date of the revised Terms constitutes your acceptance of the changes.
We encourage you to review these Terms periodically. The "Last Updated" date at the bottom of this page indicates when these Terms were last revised.
These Terms, together with the Privacy Policy and any other agreements expressly incorporated by reference, constitute the entire agreement between you and Fontavis regarding the Platform and supersede all prior agreements and understandings.
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect, and the invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable.
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision. A waiver of any provision shall only be effective if made in writing and signed by us.
You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. These Terms shall be binding upon and inure to the benefit of the parties and their permitted successors and assigns.
We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to acts of God, natural disasters, war, terrorism, riots, pandemic, government actions, or network or infrastructure failures.
